Terms of Service
The rules that apply when you use RegCheck360. Please read them carefully.

1. Who you are agreeing with
These terms are an agreement between you (or the entity you represent) and Health Icons Pty Ltd(ACN 668 459 188), an Australian proprietary company trading as RegCheck360 (“we”, “us”).
By creating an account, calling our APIs, or otherwise using the service, you accept these terms. If you are using RegCheck360 on behalf of a company, you confirm you have authority to bind it.
2. What RegCheck360 is, and what it is not
RegCheck360 is a regulatory screening tool for supplement and nutraceutical ingredients across Australia (TGA / FSANZ), Brazil (ANVISA), and Canada (Health Canada / NHPID). It provides:
- Lookups against current public regulatory data (TGA Permissible Ingredients Determination, NHPID, ANVISA lists).
- AI-assisted regulatory assessments using large language models from Anthropic.
- A directory of contract manufacturers (the “Marketplace”).
RegCheck360 is not legal advice, regulatory advice, or a substitute for a regulatory affairs consultant. Outputs are intended to help you screen products quickly. You remain solely responsible for verifying findings against the current authoritative source before any manufacturing, listing, submission, or commercial decision.
3. Accounts and access
- You must provide accurate registration information and keep it up to date.
- You are responsible for activity under your account, including any team members you invite.
- Do not share your password or API keys. If you suspect a compromise, contact security@regcheck360.com and rotate your credentials.
- You must be at least 16 years old to create an account.
4. Plans, fees, and free tier
Current pricing is published at /pricing. The Free tier has monthly caps (5 ingredient checks, 2 formulas, 1 pathway). Paid plans (Pro, Team) bill monthly or annually through Stripe. Fees are in Australian dollars unless stated otherwise and include applicable GST.
You can cancel at any time. Cancellation takes effect at the end of the current billing period; we do not refund partial periods unless required by Australian Consumer Law.
5. Acceptable use
You may not use RegCheck360 to:
- Scrape, mirror, or republish our regulatory database in bulk. Our ingredient tables are a material part of the product and we monitor for automated extraction.
- Reverse-engineer the service or use it to build a competing regulatory screening product.
- Submit content that is unlawful, defamatory, or that you do not have the right to use.
- Probe, scan, or test the vulnerability of the service without prior written authorisation. Coordinated disclosure is welcome — see /trust.
- Use the service to facilitate the sale of products that are prohibited under Australian law.
We may suspend or terminate accounts that breach these rules, that abuse API quotas, or that create risk for the platform or other users.
6. Your content and your data
You retain ownership of any content you submit (ingredient lists, formulas, label images, profile text). You grant us a non-exclusive, worldwide licence to host, process, and display that content solely to run the service and to communicate with you.
We do not use customer formula or ingredient data to train machine-learning models.If we ever change this, we will give existing customers advance notice and an opt-in choice.
7. Marketplace
The Marketplace lists contract manufacturers. We verify listings before publishing them, but we do not endorse, warrant, or guarantee any manufacturer. Quotes, contracts, deliveries, and payments are between you and the manufacturer. You are responsible for your own due diligence.
Manufacturers listed on the Marketplace agree to provide accurate information and to honour any quotes for a reasonable period after issue.
8. AI outputs
AI-generated assessments are produced by third-party large language models. They are best-effort regulatory reasoning and can be wrong, especially for novel ingredients, edge cases, or recently changed regulations. Treat AI outputs as a starting point, not a conclusion. We label every AI verdict and recommend a live regulator check before any commercial decision.
9. Service availability and changes
We aim for high availability but do not promise uptime guarantees on Free or Pro plans. Enterprise SLAs are available on the Team plan or under a separate written agreement.
We may add, change, or remove features. If a change materially reduces a paid plan’s value, we will offer a pro-rata refund or a downgrade option.
10. Intellectual property
We own RegCheck360, including the brand, software, AI prompts, regulatory mappings, and compiled databases. Public regulatory data (e.g. the TGA Determination, FSANZ standards) belongs to the issuing authority and is used under fair-dealing and public-record rules.
11. Confidentiality and trade secrets
Customer formulas are confidential. We classify them as confidential information internally, restrict employee access on a need-to-know basis, and encrypt them at rest. We will not disclose a customer formula to another customer, a manufacturer, or any third party except as required for the explicit task you initiated (e.g. sending a quote request you composed).
12. Warranties and liability
Nothing in these terms excludes any guarantees that cannot be excluded under the Australian Consumer Law. Subject to that:
- The service is provided “as is” and “as available”.
- We do not warrant that the service will be error-free or uninterrupted.
- We are not liable for any indirect, incidental, special, or consequential loss, including loss of profits, business interruption, or loss of regulatory approval.
- Our aggregate liability in any 12-month period is limited to the fees you paid us in that period, or A$200 if you are on the Free tier.
Because RegCheck360 is a screening tool, you accept that the final responsibility for any regulatory or product decision rests with you.
13. Indemnity
You agree to indemnify us against any third-party claim arising from your content, your use of the service in breach of these terms, or your violation of applicable law.
14. Suspension and termination
Either party may terminate at any time. We may suspend access without notice if we reasonably believe a serious breach has occurred or that continued access creates risk. Sections that should survive termination (IP, confidentiality, liability, indemnity, dispute resolution) survive.
15. Governing law and disputes
These terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales. Before starting court proceedings, please contact us at disputes@regcheck360.com so we can try to resolve the issue informally.
16. Changes
We will publish a new “Last updated” date at the top when these terms change. Material changes will be announced by email at least 14 days before they take effect. Continued use after the effective date means you accept the change.
